These Terms of Service ("Terms") govern the use of the LeLu Blends website and services. By engaging with LeLu Blends' services or purchasing products, you agree to comply with these Terms. Please read them carefully before proceeding.

1. General Information

LeLu Blends specialises in providing pre-made blends and signature blends using essential oils for wellness products for businesses. All products and services are handcrafted in-house by the founder of LeLu Blends, Jessie, using high-quality, all-natural ingredients. Products are not branded by LeLu Blends, and recipes remain confidential. However, full transparency is provided regarding all ingredients used.
For clarity:
• "Customer" refers to the retailer purchasing LeLu Blends products for resale under their own label.
• "End User" refers to the consumer who purchases or uses the products once they have been resold by the retailer.

Transparency & Care

All products are made using sustainably sourced ingredients, and customers will always be informed of every ingredient used in our products, ensuring full transparency. We do not add any synthetic chemicals, preservatives, or artificial fragrances to our products. LeLu Blends takes every possible measure to ensure safe production processes, as outlined in the following sections.

All products sold to you are formulated using 100% natural essential oils, herbal extracts, and carrier oils. Specific ingredients include but are not limited to:
• Pure Essential oils
• Witch hazel
• Water
• Hemp seed oil
• Jojoba oil

2. Services & Products

• Pre-Made Blends: Ready-to-use products that can be customised with a business’s own label. These are ideal for resale under a custom brand. These products come with a 5-7 business day turnaround time.
• Signature Blends: Bespoke blends created collaboratively to reflect a brand’s specific needs and preferences. These require a 5-7 business day turnaround for formulation, in addition to a 10-business day production time.
• Product Information: All blends are made with 100% natural essential oils and are free from synthetics, artificial fragrances, and harmful chemicals.

3. Ordering & Payment

• Placing an Order: Orders for pre-made blends can be made through the LeLu Blends website or by direct contact. All orders are subject to confirmation and availability. Signature blends require consultation prior to placing orders. Should the consultation be successful, LeLu Blends will issue an invoice for $149.00 for the formulation of the bespoke blend. This fee is non-refundable. Once the bespoke blend is formulated and confirmed by the customer, LeLu Blends will then issue an invoice for the product costs, which must be paid in full before production begins.

• Payment: Payments must be made in full at the time of placing an order. Various payment methods are accepted, including credit cards and online payment platforms.

4. Custom Orders

• Signature Blend Customisation: For signature blends, a detailed consultation will be arranged to understand specific needs, including scent preferences and packaging requirements.

• Changes to Signature Blends: Once a signature blend is confirmed, any changes must be communicated promptly. Modifications may result in additional charges or delays.

• No Refunds for Signature Blends: Due to the bespoke nature of signature blends, refunds are not available once production has begun.

5. Shipping & Delivery

• Shipping: Shipping costs and delivery times are calculated at checkout based on the customer’s location. LeLu Blends aims to ship orders within 3 business days, though timelines may vary depending on product availability and order complexity.

• Title Transfer: Title and risk of loss for all products pass to the customer upon shipment. The customer is responsible for filing claims with the carrier for damaged or lost shipments.

6. Returns & Refunds

• Damaged or Defective Products: If an order arrives damaged or defective, the customer must notify LeLu Blends within 3 days of receipt. Products may be replaced or refunded at the discretion of LeLu Blends.

• Non-Returnable Items: Due to the nature of the products, returns are not accepted unless they are defective.

• Refund Policy: LeLu Blends will only issue refunds if LeLu Blends cannot replace the damaged or defective items.

7. Limitation of Liability

• No Liability for Damages: LeLu Blends is not liable for damages arising from the use or misuse of products, including but not limited to personal injury, allergic reactions, or financial loss.

• Product Use: It is the customer’s responsibility to ensure products are used as intended by the end user, and also the customer’s responsibility to notify the end user of ingredients used, usage instructions, and care instructions. If there are concerns about allergies or sensitivities, end users should consult a professional before use. LeLu Blends recommends that all customers conduct appropriate safety testing prior to using products in commercial settings.
• Capping of Liability: The total liability of LeLu Blends for any claim under these Terms will not exceed the amount paid for the product that is the subject of the claim.

8. Indemnification

Customers agree to indemnify and hold LeLu Blends harmless from claims, damages, losses, liabilities, and expenses (including legal fees) arising from the use of products or services, any breach of these Terms, or any violation of the law or third-party rights.

9. Intellectual Property

• Ownership: All content on the LeLu Blends website, including text, images, logos, and product designs, is the intellectual property of LeLu Blends and is protected by copyright and trademark laws.

• Non-Exclusive License: Retailers are granted a non-exclusive license to resell LeLu Blends products under their own brand, but the proprietary formulas and blend recipes remain the intellectual property of LeLu Blends.

• Confidentiality: Signature blends created by LeLu Blends for specific retailers remain confidential and may not be shared or sold to third parties.

10. Governing Law

These Terms are governed by the laws of Australia.

11. Changes to Terms

LeLu Blends reserves the right to update or modify these Terms at any time. Changes will be posted on this page, and the updated version will take effect immediately upon posting. Continued use of the website or services after any changes constitutes acceptance of the new Terms.
